COMMON QUESTIONS AND DILEMMASWhat you need to know about divorce in Germany
While every divorce is unique, here are the answers to the key questions for divorce cases under German family law.

Custody decisions depend on caregiving roles and practical considerations. If you are the primary caregiver, you will likely retain custody, with visitation rights granted to the other parent. Shared custody is common when both parents work full-time. Factors like infidelity or occasional substance use rarely impact custody decisions under German law.

In Germany, alimony is tied to child support and maintaining the standard of living established during the marriage. If you supported your spouse financially or have a significantly higher income, you may be required to continue providing support, regardless of who was at fault for the divorce.

In Germany, child support is required regardless of marital status. The amount depends on the non-custodial parent's income and the child's age, as outlined in the 'Düsseldorfer Tabelle', which ensures fair and consistent calculations.

The Düsseldorfer Tabelle is a widely used guideline in Germany for calculating child support. It provides standardized amounts based on the non-custodial parent's income and the child's age. Here’s the most recent update to ensure accurate and fair calculations.

In Germany, a single mother may receive spousal support if childcare responsibilities, particularly for young children, prevent her from working. The amount and duration depend on the child's age, her ability to work, and the standard of living during the relationship. Each case is assessed individually.

Pension entitlements earned during the marriage — whether private or state pensions — are usually divided equally between spouses.

• Private pension entitlements: Contributions made during the marriage are split equally. Deviations from this rule are extremely rare.

• State pension entitlements: These are also divided equally, and this process is mandatory under German law. Agreements deviating from equal division are not permitted.

Assets acquired during the marriage are typically divided equally. Pre-marital assets, inheritances, and gifts remain with the original owner. However, increases in the value of pre-marital property during the marriage may also be considered.

In Germany, assets acquired during the marriage are usually divided equally. This includes marital property, pensions, and jointly acquired assets. However, property owned before the marriage, inheritances, and gifts typically stay with the original owner. Debts accrued during the marriage are also considered in the division.

Shared assets are allocated based on practical needs. For example, the car may go to the spouse who needs it most for work, while the primary caregiver is usually granted the family’s rental apartment. In cases of shared custody or no children, these decisions are made based on necessity and prior use.

Negotiations can save time and money, but they require cooperation. If your spouse or their lawyer is uncooperative, negotiations may lead to unnecessary delays and higher costs. In such cases, court proceedings often provide a more structured and cost-effective resolution, with the judge managing discussions to ensure fairness.
